Tsumiki no Yado — Terms and Conditions of Accommodation

Article 1 (Scope of Application)

1

These Terms and Conditions of Accommodation (the "Terms") set out the rights and obligations between Tsumiki General Incorporated Association (the "Company"), which operates the accommodation facility "Tsumiki no Yado" (the "Inn"), and any person who enters into an accommodation contract or a related contract with the Company for a stay at the Inn (the "Guest").

2

Matters not provided for in these Terms shall be governed by laws and regulations or by generally established practice.

3

Where the Company agrees to a special arrangement to the extent that it does not conflict with laws, regulations or practice, that arrangement shall take precedence notwithstanding the preceding paragraph.

Article 2 (Application for an Accommodation Contract)

1

When applying for an accommodation contract or making a reservation, the Guest shall provide the Company with the following information:

  1. (1)

Name and contact details of the Guest

  2. (2)

    Date(s) of stay

  3. (3)

    Accommodation plan to be used

  4. (4)

Any other information the Company deems necessary

2

If, during the stay, the Guest requests to extend the stay beyond the reserved dates, the Company will treat the request as a new application for an accommodation contract made at the time of the request.

3

The accommodation plan is valid only as selected at the time of application. A Guest who wishes to stay under a different plan must submit a new application. The original reservation is not automatically cancelled, and the Guest must take the necessary steps separately.

4

To prevent improper resale and to offer all guests a fair opportunity to stay, the Guest applies for an accommodation contract on the understanding that the position under the contract, or any right arising from it, may not be transferred to a third party unless the Company expressly consents.

5

So that the Company can offer as many guests as possible the opportunity to stay, the Guest applies for an accommodation contract on the understanding that the same person may not, without reasonable grounds, apply for overlapping stays on the same date or for multiple stays on similar dates.

Article 3 (Conclusion of the Accommodation Contract)

An accommodation contract is concluded when the Company accepts the application described in the preceding Article. However, depending on the accommodation plan, the contract is concluded when the Guest has made advance payment after applying and the Company has confirmed receipt. This does not apply where the Company proves that it did not accept the application.

Article 4 (Refusal to Conclude an Accommodation Contract)

The Company may decline to conclude an accommodation contract in the following cases:

  1. (1)

The application is not made in accordance with these Terms.

  2. (2)

No room is available because the Inn is fully booked.

  3. (3)

The Guest or a user of the facility is found to fall under any of (a) to (c) below:

    1. (a)

A member of an organized crime group as defined in the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) ("organized crime group"), a member of such a group ("organized crime group member"), a quasi-member or associate of such a group, or any other anti-social force.

    2. (b)

A corporation or other organization whose business activities are controlled by an organized crime group or an organized crime group member.

    3. (c)

A corporation any of whose officers is an organized crime group member.

  4. (4)

The Guest is found likely to act, in connection with the stay, in violation of laws and regulations, public order or good morals.

  5. (5)

The Guest is a patient with a specified infectious disease or a person in a similar position.

  6. (6)

Violent demands are made in connection with the stay, or a burden beyond a reasonable extent is demanded.

  7. (7)

The Company is unable to accommodate the Guest due to a natural disaster, a facility malfunction or other unavoidable reasons.

  8. (8)

The Guest is found likely not to comply with these Terms or with the house rules set by the Company on the Inn's premises.

  9. (9)

The case falls under the provisions of the prefectural ordinance enforcing the Hotel Business Act that has jurisdiction over the Inn.

Article 5 (Cancellation of a Reservation by the Guest)

1

If the person who made a reservation cancels all or part of it, the Company will charge a cancellation fee as set out below.

2

Cancellation fees are charged at the rates in the table below, according to when the reservation is cancelled.

3

If the Guest has not arrived by 8:00 p.m. on the day of stay without contacting the Company, the Company may treat the reservation as cancelled by the person who made it.

4

If the number of reserved nights is shortened, the cancellation fee will be charged at the applicable rate based on one night (the first night), regardless of how many nights are shortened.

5

Where a reservation is deemed cancelled under paragraph 3 and it is proven that the Guest failed to arrive without contacting the Company because of the non-arrival or delay of a train, aircraft or other public transportation, or for any other reason not attributable to the Guest, the cancellation fee under paragraph 1 will not be charged.

The Guest makes coercive and unjust demands such as violence, threats or extortion against the Inn or its staff, or demands a burden beyond a reasonable extent.

  6. (6)

The Guest does not comply with prohibitions in these Terms or in the house rules set by the Company.

  7. (7)

The case falls under the provisions of the prefectural ordinance enforcing the Hotel Business Act that has jurisdiction over the Inn.

  8. (8)

Minors attempt to stay on their own without the permission of a parent or guardian.

  9. (9)

The Company is unable to provide the contracted room to the Guest for a reason other than that in item 3 (in which case the Company will, as far as possible, arrange alternative accommodation).

Article 8 (Hours of Use)

The Guest may use the Inn's rooms from the check-in time to the check-out time set for each accommodation contract.

2

Notwithstanding the preceding paragraph, the Company may allow use of the rooms outside those hours. In that case, an additional charge will apply.

Article 9 (Compliance with House Rules)

While at the Inn, the Guest shall follow the house rules set by the Company and posted on the Inn's premises.

2

Accommodation and other charges shall be paid to the Company in cash or by credit card or another method accepted by the Company, at any time from the conclusion of the accommodation contract until check-out, or when requested by the Company.

3

The accommodation charge will be payable even if the Guest voluntarily does not stay after the Company has prepared the room and made it available for use.

Article 11 (Handling of Luggage and Belongings)

1

If the Guest's luggage arrives at the Inn before the stay, the Company will take responsible care of it only if the Company agreed to this before its arrival (including by a method designated by the Company), and will hand it over at check-in.

2

After check-out, the Company will take responsible care of the Guest's luggage or belongings only if it has agreed to do so in advance. If they are not collected within the storage period agreed in advance, they will be treated as intentionally abandoned and ownership as relinquished.

3

If, after check-out, the Guest's luggage or belongings are left behind without the Company's consent, and it can reasonably be inferred that they were left intentionally, or the Guest has not contacted the Company about them within the storage period set by the Company from the day of check-out, they will be treated as intentionally abandoned and ownership as relinquished.

However, if the reason is not attributable to the Company, the Company shall not be liable to pay any penalty or similar amount.

Article 13 (Liability of the Guest)

I was able to spend a truly relaxing time in a location surrounded by abundant nature. The inn, a renovated 90-year-old traditional Japanese house, allowed me to feel the warmth of the wood. The story of how it was created together with children was also wonderful, and I would like to support their activities. I would definitely like to stay again. Thank you very much.

This inn, with its beautifully preserved old-world charm, warm and wonderful owner, easy access from the city center, and a natural setting that inspires creativity, was absolutely fantastic in every way! We used it for a day trip with a company gathering, but it's a place we'd love to return to for a longer, more extended stay. It was incredibly refreshing! ✨ A highly recommended place for anyone with a busy daily life. Thank you so much!

I stayed there in the middle of winter, but the heating system was excellent, so I didn't feel cold at all. The weather was nice on the day I stayed, and the starry sky was beautiful. The place had a nostalgic feel reminiscent of the past, but the bathrooms were modern, making for a very comfortable stay.
